1. Our role as a marketplace

XposedAuto provides a venue for dealers to publish vehicle listings and for buyers to browse listings, request estimates and send enquiries. We are not a party to any vehicle sale, reservation, financing or insurance arrangement.

Any contract for the purchase of a vehicle is made solely between you and the dealer named on the listing, on that dealer's own terms. We do not take possession of vehicles, hold deposits on a dealer's behalf, or guarantee that any listed vehicle is available, roadworthy or as described.

2. Listings and vehicle information

Each listing is prepared and published by the dealer. While we require dealers to keep their listings accurate and current, specifications, model year, mileage, condition, photographs, location and availability are provided by the dealer and may change without notice.

Catalogue information shown on this website (including make, model, variant, chassis code and specifications) is reference material only and does not form part of any vehicle sale contract.

• Treat listing details as a starting point and confirm all material facts with the dealer before paying any booking fee or deposit.
• For recon vehicles, ask the dealer for the auction sheet and grading, mileage and accident-history evidence, and the vehicle's Approved Permit (AP) and registration status.
• Arrange an independent inspection (including a Puspakom inspection where applicable) before committing to a purchase.

3. Reference prices and landed-price estimates

Prices shown on listings are reference values published by dealers. Any estimated landed price produced by our estimator is an indicative calculation based on the inputs you provide and the duty, tax and fee parameters available to us at the time.

Actual import duty, excise duty, sales tax and other charges are determined by the Royal Malaysian Customs Department and other authorities under the laws in force at the time of clearance and registration, and may differ from any estimate shown. Always confirm the final on-the-road price in writing with the dealer.

4. Recon vehicle compliance

Reconditioned vehicles imported into Malaysia are subject to requirements that may include a valid AP issued under MITI policy, JPJ registration, and Puspakom inspection. Compliance is the responsibility of the importing dealer.

You should satisfy yourself — before purchase — that the vehicle can be and will be properly registered in your name, including the year of manufacture rules applicable to imported used vehicles, and obtain written confirmation from the dealer where anything is unclear.

5. Enquiries, reservations and deposits

Sending an enquiry or requesting an estimate through this website creates no obligation on either side. A reservation or booking is only effective on the terms agreed directly with the dealer.

Any booking fee, deposit or payment is paid to the dealer under the dealer's own terms and refund policy. Never transfer money to personal bank accounts or third parties claiming to represent a dealer; verify payment instructions through the dealer's official channels.

6. Financing and insurance

References on this website to hire-purchase, loan or insurance options are general information only. Approval, pricing and terms are determined solely by the relevant bank, finance company or insurer, and hire-purchase arrangements in Malaysia are governed by the Hire-Purchase Act 1967.

We do not provide credit, act as a credit broker, or advise on the suitability of any financing or insurance product.

7. Accounts and acceptable use

Where you create an account, you must provide accurate information, keep your credentials confidential, and promptly notify us of any unauthorised use. You are responsible for activity under your account.

• Do not submit false, misleading or infringing content, including vehicle listings you are not authorised to publish.
• Do not scrape, copy or republish listing data or images except through normal browsing.
• Do not interfere with the operation of the website or attempt to access dealer or buyer data you are not entitled to.
• Do not use the website for any unlawful purpose under the laws of Malaysia.

8. Intellectual property

This website, its design, text, graphics, logos and software are owned by or licensed to us and are protected by the intellectual property laws of Malaysia. Listing photographs and descriptions remain the property of the publishing dealer or their licensors.

You may view and print pages for your personal, non-commercial use in connection with a genuine vehicle enquiry. Any other reproduction requires our prior written consent.

9. Limitation of liability

To the maximum extent permitted by law, including the Consumer Protection Act 1999, we exclude all warranties and representations relating to this website, listings, estimates and dealer conduct, whether express or implied.

We are not liable for any loss arising from your reliance on listing content or estimates, the acts or omissions of dealers, vehicle defects, failed transactions, or interruptions to the website. Nothing in these terms limits liability that cannot be limited under Malaysian law, and nothing affects your right to refer a consumer dispute to the Tribunal for Consumer Claims (Tribunal Tuntutan Pengguna Malaysia).

10. Indemnity

You agree to indemnify and hold us harmless against claims, losses and costs (including legal costs) arising from your breach of these terms, your misuse of the website, or content you submit to the website.

11. Changes, suspension and termination

We may update these terms, modify or suspend any part of the website, or suspend or terminate accounts that breach these terms, without prior notice. The version in force at the time of your use applies. Continued use after changes are published constitutes acceptance of the updated terms.

12. Governing law and contact

These terms are governed by the laws of Malaysia. Any dispute shall be subject to the non-exclusive jurisdiction of the courts of Malaysia.
